Halle Berry and Olivier Martinez’s long-running custody battle has taken another difficult turn. A Los Angeles judge has left Martinez with primary physical custody of their 13-year-old son, Maceo, while rejecting Halle’s request to restore their previous 50/50 arrangement. The judge also ruled that Halle cannot have overnight visits for now. The custody arrangement is temporary and is expected to be reviewed again in November.
There was one significant ruling in Halle’s favour: the court dissolved the temporary domestic violence restraining order Martinez had obtained and denied his request for a longer-term order. Martinez had accused Halle of physically abusing Maceo during a September incident. Halle has firmly denied ever abusing their son.
Halle’s representative says she still shares joint legal custody and retains tie-breaking authority when the former couple cannot agree on certain decisions. Martinez had also sought tighter restrictions on Halle’s holiday time with Maceo, but that request was denied.

The case has become deeply contentious. Maceo testified privately during the proceedings, with both parents excluded from the courtroom during his testimony. Halle had objected to him testifying and argued that Martinez had influenced his account. Martinez denies acting improperly and says his actions are about protecting their son.
There is no way to look at a custody case this personal and know everything happening inside a family from court filings alone. But one thing is clear: the judge’s refusal to grant Martinez a permanent restraining order matters. So does the fact that this custody arrangement is not necessarily final.
Halle has publicly said she has never physically, emotionally or otherwise abused Maceo and has described herself as a survivor and advocate for domestic violence victims.
For now, Martinez has primary physical custody and Halle’s overnight visits remain suspended. The court will revisit the custody issues in November, which means this story is far from over.
