The legal notice, dated January 10, 2026, was issued on behalf of Adichie and her partner, Dr Ivara Esege. It alleges that Euracare, its anesthesiologist, and attending medical staff breached their duty of care during procedures carried out on January 6. The child had been referred to the hospital from Atlantis Pediatric Hospital ahead of a planned medical evacuation to the United States.

According to the notice, doctors administered intravenous sedation using propofol for diagnostic and preparatory procedures. The document alleges failures in monitoring, airway protection, and patient transfer during sedation. It also claims that staff moved the child between clinical areas without adequate oxygen, equipment, or supervision, before he later died in the early hours of January 7.

Demands for Records and Evidence Preservation

The legal team has demanded certified copies of all medical records linked to the child’s care within seven days. These include consent forms, anesthetic charts, monitoring logs, nursing notes, ICU records, and incident reports. The notice also requests the identities of all staff involved and access to any internal reviews connected to the case.

Solicitors have further instructed the hospital to preserve all physical and electronic evidence. This includes CCTV footage, monitoring data, pharmacy logs, emergency equipment records, and internal communications. The notice warns that any loss or alteration of evidence could carry serious legal consequences.

Official Responses and Escalating Scrutiny

Lagos State Governor Babajide Sanwo-Olu has ordered a probe following public concern over the child’s death. Euracare has previously issued a statement expressing condolences to the family while rejecting claims of negligence, stating that it followed accepted clinical standards and had begun an internal review.

Members of the family have challenged that account. Dr Anthea Esege Nwandu, the child’s aunt and a senior physician, has publicly disputed the hospital’s version of events and cited what she describes as departures from international pediatric anesthesia standards. These competing accounts now sit alongside the formal legal process, with no regulatory or judicial findings released to date.

As matters stand, the legal notice places the case firmly within the hands of investigators and the courts. The family has indicated that it will pursue further legal and regulatory action if the hospital fails to comply with the demands set out in the notice.
